UTAG Strike : UTAG is Obligated to Return to Class after Swearing an Affidavit – NLC; Following the Accra High Court’s decision to grant an interlocutory injunction against their industrial action, Ofosu Asamoah, Executive Director of the National Labour Commission (NLC), said members of the University Teachers Association of Ghana (UTAG) are expected to return to work.
Mr. Asamoah stated that UTAG members are obligated to return to work after swearing an affidavit to cease their strike if an injunction is granted by the court.
In their sworn affidavit, they told the court that if the court upholds our affidavit they will have no option than to return to the classroom, so I do not think they can go back on their word. It is a sworn affidavit before the court
During Tuesday’s proceedings, the NLC’s legal team asked the court for an interlocutory injunction against UTAG’s conduct before the hearing of its substantive case, which seeks enforcement of the NLC’s direction to UTAG to end its strike.
However, UTAG’s lawyer, Kwasi Keli-Delataa, opposed to the petition and urged the court to focus on the main matter at hand.
His Lordship Rockson Aboadwe, in his judgement, stated that if the strike continues, the parties’ negotiations will not generate the desired results, and thus granted the injunction.
According to the NLC, the court will rule on the substantive case on February 22, 2022.
